Cookies

Like most shopping sites, we use cookies to keep track of your current session on our Website and to enable you to store items in your shopping basket while you are on the site. A cookie is a small text file that a website sends to your browser, which may then store it on your system. Most browsers are set to accept cookies by default, but you do not have to accept cookies, and your browser will give you the option of whether to accept or reject them.

We use cookies to store items in your basket, and so if your browser is set to reject cookies, you will be unable to shop on our Website. However, you will still be able to browse our product and information pages.

Cookies are completely safe and do not store any personal information but allow us to understand when you visit our Website, how you use it and what products and services that might interest you. This enables us to personalize the content you see on the Website so that we show you things that are most relevant to you and to test changes to the Website to improve your online experience. For more information on cookies, you can visit the Information Commissioner’s Office website.

We are constantly working to improve our Website and the experience that our customers have when they visit it and we work with trusted partners who use cookies to enable us to show you products or services that we think may be relevant to you based on previous purchases or browsing behaviour. If you leave our Website to visit certain selected third party websites, we can also provide adverts and offers related to products that you have recently viewed or might be interested in. To do this, we may work with partners who are members of the Network Advertising Initiative (NAI). If cookies are not enabled on your computer then you will not be able to shop on our site as we use them to record what products you place in your shopping basket.

We use the following types of cookies:

Strictly necessary cookies. These are cookies that are required for the operation of our website. They include, for example, cookies that enable you to log into secure areas of our website, use a shopping cart or make use of e-billing services.

Analytical/performance cookies. They allow us to recognise and count the number of visitors and to see how visitors move around our website when they are using it. This helps us to improve the way our website works, for example, by ensuring that users are finding what they are looking for easily.

Functionality cookies. These are used to recognise you when you return to our website. This enables us to personalise our content for you, greet you by name and remember your preferences (for example, your choice of language or region).

You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of our website may become inaccessible or not function properly.

User-Generated Material

We allow customers to submit material to us on this website or other websites we are affiliated to or have a presence on, such as, but not exclusive to, social media websites and video posting websites. These include, but not exclusive to, written product reviews and rates. We define the term “user-generated material” to mean any material of any kind that you submit to us, including (but not limited to) text, files, images, video or sounds. It does not include the personal information you provide when you place an order or register, or if you subsequently change that information. Other users to the website or other platforms mentioned as classed above may see the user-generated material.

If you review or submit user-generated material you agree to do so under these Terms and Conditions. If you do not want to review or submit user-generated material under these Terms and Conditions, then you should not do so.

We do not systematically review user-generated material submitted by users of this website. We are not responsible for the content of the user-generated material, and, therefore, we do not necessarily endorse any opinion contained in such material. We make no warranties or representations, either express or implied, about user-generated material, including as to its legality or accuracy. We disclaim all liability in connection with user-generated material to the extent permitted by law.

We reserve the right, in our sole discretion, to refuse to post or to remove or edit any of your user-generated material, or to restrict, suspend, or terminate your access to all or any part of this website, particularly where user-generated material breaches this clause of these Terms and Conditions and we may do this with or without giving you any prior notice.

We do not claim any ownership rights in user-generated material. However, by submitting user-generated material you hereby grant to us an irrevocable, perpetual, non-exclusive, royalty-free, transferable and worldwide license to use, reproduce, modify, prepare derivative works of, display and perform that user-generated material in any media. The license you grant us will terminate when your user-generated material is removed from our website. If you do not agree with this policy then do not submit any user-generated material.

We may link user-generated material or parts of user generated material to other material, including material submitted by other users of this website or created by us and/or other third parties. We may use user-generated material for our internal business purposes, for example, to examine trends and to use those on this website or to promote, market or advertise our interests. We will not sell your user-generated material to third parties but you acknowledge that we may indirectly commercially benefit from it.

Each time a visitor to the site submits user-generated material to us, you represent and warrant to us as follows:

You own your user-generated material or have the right to submit it, and in submitting it you will not be infringing any rights of any third party, including intellectual property rights (such as copyright or trade mark), privacy or publicity rights, rights of confidentiality or rights under contract.

Your user-generated material is not illegal, obscene, defamatory, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offence, give rise to civil liability, violate any law, or otherwise inappropriate.

Your user-generated material does not advertise any product or service or solicit any business.

Your user-generated material does not identify any individual (including by way or name, address or a still picture or video) under the age of 18, and if your user-generated material identifies any individual over the age of 18, you have that person’s consent to being identified in exactly that way in your user-generated material.

The user-generated material that is submitted must not be in any way offensive or derogative to an individual or team/club.

General Conditions of Credit

Credit is only available and granted subject to status, credit checks, conditions and applications meeting Zopa Embedded Finance Limited‘s policies, to persons over 18 years old.

If you are accepted for credit, you will be required to sign a full legal agreement.

All advertisements of credit, authorised by Zopa Embedded Finance Limited, are subject to status, age and availability and do not constitute offers of a credit facility.

Initial instalment amounts shown on advertising material may vary slightly due to rounding, but the overall order total and amount repaid for the product will never be more than the order total advertised.

Our credit product is only available to UK residents.

We accept most debit and credit cards held by individuals who are UK residents.

Responsible Lending

Zopa Embedded Finance Limited is committed to responsible lending. It is important that you do not take on more borrowing than you can afford. If you miss your repayments, this may impact your credit rating. Remember if you run into difficulties with your repayments, please contact us immediately. We will endeavour to treat you with respect, empathy and will exercise forbearance. We do not charge late or hidden fees, nor will we charge any additional interest.

The Consumer Credit Act 1974 states that irresponsible lending may be considered by the FCA to be deceitful, oppressive or otherwise unfair or improper. This conduct is incompatible with our operating principles.

We uphold the overarching principles of consumer protection and fair business practice in our consumer credit. As part of our adherence to our policies, we will only lend an amount of credit that we are reasonably satisfied that you, in your capacity, can repay throughout the duration of the Credit Agreement.

We consider each Credit decision individually based on what we know about your circumstances and your credit and repayment history. This is an automated process, but you can request that this is done manually.

We strictly observe the requirement to undertake due diligence on all our customers. This means we will not complete any transaction and send out goods until we are sure we know who you are following the provisions of the Money Laundering Regulations 2007.

There are no hidden fees or charges, so you know how much you will repay before committing to the Credit.

Severability

The Terms of Use of this site shall be deemed severable. If any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law and such determination shall not affect the validity and enforceability of any other remaining provisions.

Governing Law

The Terms of Use of this site are governed by the laws of England and Wales. Any dispute regarding this site shall be subject to the exclusive jurisdiction of the English courts.
